But in the year following online poker&#8217;s Black Friday, brick and mortar poker room revenues haven&#8217;t necessarily kept pace.</p>
<p>From February 2011 to February 2012, according to the the <a href="http://gaming.nv.gov/documents/pdf/1g_12feb.pdf" target="_blank">latest Nevada Gaming Control Board report</a>, the state&#8217;s total gaming revenues (excluding sports books) increased by 5.6 percent, while revenues from poker dropped 1.4 percent. Las Vegas&#8217; Clark County grew gaming revenues by 6.6 percent, while poker revenues slipped 1.1 percent.</p>
<p>Atlantic City has struggled with competition from new slot parlors in Pennsylvania. But even here, the toll on poker was larger. The<a href="http://www.nj.gov/oag/ge/docs/Financials/MGR2012/201203revenue.pdf" target="_blank"> latest report from New Jersey&#8217;s Division of Gaming Enforecement</a>, Atlantic City&#8217;s total gaming revenue fell 5.0 percent from March 2011 to March 2012. Poker revenues fell 6.9 percent.</p>
<p>One poker room in Atlantic City handily beat the trend. Revenues at the Borgata&#8217;s poker room rose 28 percent. The Borgata played host to a number of major tournaments in the past year. The poker room staff is also very active on online poker forums such as 2+2.</p>
<p><span id="more-34174"></span>For years, casino operators fought the legalization and regulation of online poker. Although their objections were couched in the language of protection and oversight, as in this American Gaming Association&#8217;s (AGA) <a href="http://www.americangaming.org/newsroom/press-releases/aga-board-decision-internet-gambling" target="_blank">May 2001 press release</a>, the real issue was revenue. Casinos believed that online poker might cut into the take of their brick and mortar poker business.</p>
<p>The data, however, suggests that online poker did not cannibalize brick and mortar poker rooms. In fact, it may have been a de facto farm system for casino poker rooms.</p>
<p>By the time the American Gaming Association (AGA) officially <a href="http://www.americangaming.org/newsroom/press-releases/american-gaming-association-supports-%E2%80%9Cprohibition-internet-gambling-internet" target="_blank">changed its stance in December 2010</a> supporting the legalizing and regulation of internet poker, the UIGEA was a done deal. Black Friday was just the icing on the cake that the casinos helped bake.</p>

<p>Kentucky-based Churchill Downs, now owner of Bluff Magazine, operates <a href="http://www.twinspires.com/content/" target="_blank">TwinSpires</a>, one of the country&#8217;s only legal online gambling sites (thanks to the UIGEA carve out for horse racing).</p>
<p>UK-based Betfair, owner of  <a href="https://www.tvg.com/" target="_blank">TVG</a>, another legal online horse wagering site operating in the US, just completed a<a href="http://articles.latimes.com/2012/apr/23/sports/la-sp-dwyre-20120424" target="_blank"> five-year naming rights deal</a> with California&#8217;s Hollywood Park.  </p>
<p>And now Las Vegas-based casino operator <a href="http://www.washingtonpost.com/business/pinnacle-entertainment-buys-majority-stake-in-retama-park-racetrack-near-san-antonio/2012/04/26/gIQAf2uHkT_story.html" target="_blank">Pinnacle Entertainment bought a 75.5% stake in Retama Park </a>in Texas for $22.8 million. Since Texas is one of the few states that hasn&#8217;t legalized gambling, Retama is an unlikely racino conversion. Pinnacle could, however, augment its revenues with an online wagering site.   </p>
<p>In the not too distant past, parimutuel racing was a stagnant enterprise. But the industry&#8217;s UIGEA exemption has made it a gateway to online gaming revenues, initially from horse racing, and perhaps ultimately from poker.</p>

<p>Lawsuits and bankruptcies are a corporate voyeur&#8217;s dream. Legal disclosures offer an upskirt peak at a company&#8217;s financial panties. In the case of Federated Sports &amp; Gaming, parent of the troubled Epic Poker League, bankruptcy filings reveal a full-fledged internet domain-name fetish. <a href="http://www.kickasspoker.com/2012/04/06/hundreds-of-lols-federated-sports-gamings-domain-registration-stash/ ">Literally hundreds of domain names were listed among Federated&#8217;s personal property</a> &#8230; and in that list, perhaps, lies a bigger story about Epic&#8217;s intent.</p>
<p>Companies often buy variants of their own domain names to foil malicious cyber squatters and aid surfers prone to typos and spelling errors. This explains why Federated bought epicpoker.us, epicpoker.xxx, eepicpoker.com and eapicpoker.com along with its primary domain name, epicpoker.com. </p>
<p>Perhaps proving Federated was more psychic than solvent, <strong>epicpokerfail.com</strong> and <strong>epicpokerfailure.com</strong> were among the company&#8217;s portfolio of web properties. Of course my favorite was <strong>fuckepicpoker.com</strong>. </p>
<p>And why epicpokerstars.com but no epicfulltiltpoker.com?</p>
<p>It&#8217;s hard to know whether names like epicbridge.com, epiccasino.com, epiccheckers.com and epicsportsbook.com represent Federated&#8217;s expansion plans, reveal a business model dependent on online gambling legalization, or was just the results of a bad case of domain-name OCD. </p>
<p>The list goes on and on &#8212; everything from palmspoker.eu, .net, and .co.uk to epicscotch/rum/tequila.com &#8212; and you can only wonder what market verticals Epic was thinking about when they locked down ticklemedanny.com.</p>
<p>But particularly curious are dozens of web addresses starting with &#8220;wicked&#8221; &#8212; wickedpoker.com, wickedchess.com, wickedbasketball.com, etc. Since Federated isn&#8217;t based in Boston, this presumably has something to do with <a href="http://wickedchopspoker.com/" target="_blank">the talented boys over at Wicked Chops Poker</a>. No wonder their coverage of the #EpicFail has been so &#8230; well &#8230; I hear they <a href="http://wickedchopspoker.com/a-very-rare-wicked-chops-week-off/" target="_blank">had to take last week off</a> just to search for the near-NSFW pics to pair with their story of who ultimately got who&#8217;s what in the end.</p>

<p>It seems now wherever he goes, Steve Wynn has a team of bodyguards trailing behind him. And according to <a href="http://www.lvrj.com/news/steve-wynn-hires-more-bodyguards-142177343.html" target="_blank">this article</a>, Steve is supposedly drawing his protection from a pool of ex-Navy Seals.</p>
<p>The added security detail is coincident with his <a href="http://pokerati.com/2012/01/steve-wynn-in-partner-spat-over-asian-pursuits/" target="_blank">high-profile tiff </a> with Wynn&#8217;s one-time partner Kazou Okada. After the two exchanged dueling lawsuits, Wynn forced Okada off the company&#8217;s board of directors and cashed him out of his Wynn stock holdings at a deep discount.</p>
<p>But if the situation did escalate from legal to physical, we feel Steve Wynn could do just fine without bodyguards. By all appearances, Wynn looks to have both the height and reach advantage on Okada.</p>
<p>They say it&#8217;s lonely at the top. That appears to be especially true for Wynn. The business publication<a href="http://www.lvrj.com/business/barron-s-drops-steve-wynn-from-top-ceo-list-144306315.html" target="_blank"> Barron&#8217;s recently dropped Wynn </a>from their annual list of top chief executives. Wynn&#8217;s wife Elaine divorced him &#8212; for the second time. Fallout from the divorce included the departure of Andrew Pascal, President of Wynn&#8217;s Las Vegas properties and Elaine&#8217;s nephew. And after more than a decade alliance, Wynn and Chef Alex Stratta severed ties last year.</p>
<p>Maybe Wynn hired a few buff bodyguards just for the company.</p>

You could also say that the gambling city of Las Vegas is built &#8212; and rebuilt &#8212; on the idea of fresh starts. Rooms are gutted and names are changed at a frenetic pace, all with a goal to wipe the slate clean.</p>
<p>If you haven&#8217;t been to Vegas lately, these are some of its latest reincarnations:</p>
<p>On May 15, 2011, the Sahara closed its doors. At the time, there were no plans for the Rat Pack&#8217;s former home. But in November, the Clark County Commissions approved plans to renovate the property. Alas, the roller coaster will not live to see another day.</p>
<p>The Las Vegas Hilton is now LVH- Las Vegas Hotel and Casino: The hotel, located near the convention center, lost its Hilton franchise in January. The LVH is currently being run by a court approved receiver while Goldman Sachs proceeds with its foreclosure of the property.</p>
<p>Fitzgeralds Casino &amp; Hotel changed its name the D Las Vegas. The &#8220;D&#8221; apparently stands for &#8220;Downtown,&#8221; &#8220;Detroit&#8221; (hometown of the Stevens brothers who now own the property) and/or CEO Derrick Stevens&#8217; nickname &#8220;D.&#8221; The new owners are also kicking in $15 million to renovate the old Fitz.</p>
<p>O&#8217;Shea&#8217;s celebrated one last Saint Patrick&#8217;s Day before it closes its doors on April 30, 2012. But this Strip casino owned by Caesars Entertainment will rise again. The new O&#8217;Shea&#8217;s will open as part of the Linq project, due for completion sometime in mid-2013.</p>
<p>Wynn Resorts has a restaurant named Okada, named after a one-time (?)  partner in the casino. But <a href="http://pokerati.com/2012/01/steve-wynn-in-partner-spat-over-asian-pursuits/" target="_blank">Steve Wynn and Kazou Okada have been embroiled in an epic feud</a>. As a result, the restaurant will be renamed Ohtaki and will include some changes to the menu.</p>
<p>Steve Wynn also cut ties with chef extraordinaire Alex Stratta. Needless to say the Wynn&#8217;s restaurant Alex has disappeared and will be replaced with a new nightclub named Climaxx.</p>
<p>The Lady Luck closed in 2006 for renovations. But financing collapsed and the lay dormant for years. But the downtown casino and hotel is now scheduled for a rebirth as the Downtown Grand in April 2013.</p>
<p>The Playboy Club at the Palms is closing in June 2012. Will the rabbit warren be reincarnated?  The Vegas odds are in its favor.</p>

Surprisingly, airfares to Vegas are substantially lower this year. Use <a href="http://www.expedia.com/daily/trend_tracker/default.asp" target="_blank">Expedia&#8217;s &#8220;Trend Tracker”</a> to see how much lower your route is this year over last. Low cost carriers have added flights to Vegas in the past year, keeping a lid on airfares. Spirit Airlines has added 119 weekly flights into Vegas since last year and Allegiant enjoy Air has added 32 flights per week &#8212; while higher cost carriers have cut back. According to their latest financial statements, the ADR for MGM Strip properties is $127, up 10.4% from last year. The ADR for Caesars Entertainment’s Las Vegas properties is up 8.3 percent to $9.  The Wynn’s ADR is up 15.2 percent over last year, coming in at $242.</p>

<p>Back in the day, gambling establishments made their problems disappear somewhere out in the Nevada desert. Perhaps that&#8217;s where we&#8217;ll find MGM&#8217;s legal documents?</p>
<p>MGM has been embroiled in a years-long legal battle with City Center&#8217;s general contractor Perini Building Company. The case took a bizarre turn last week when MGM notified the court that <a href="http://www.lvrj.com/business/warehouse-official-thought-to-sell-citycenter-defect-case-papers-to-shredder-141156613.html" target="_blank">a rogue warehouse manager sold more than 500 boxes of legal documents </a>to a paper recycler for roughly $800. <br />

Overall, it wasn&#8217;t a great news week for MGM. Billionaire Kirk Kerkorian, <a href="http://www.casinocitytimes.com/article/kerkorian-sells-20-million-mgm-shares-60599" target="_blank">continued to dump shares of the casino company</a> he founded. He reportedly raked in $268 million for the 20 million shares he sold on February 27. <br />

<strong>Wynn: Stock Halted after Premature/Erroneous Filing</strong></p>
<p>The<a href="http://pokerati.com/2012/01/steve-wynn-in-partner-spat-over-asian-pursuits/" target="_blank"> messy divorce between Wynn Resorts and one-time (?) partner Kazou Okada </a>continues to be the fodder of many news stories. But that isn&#8217;t what temporarily halted the shares of Wynn from trading on the stock exchange on March 2.</p>
<p>Wynn filed a document with the SEC about getting the concession to build a new casino in Macau, the world&#8217;s hottest gaming territory. Wynn&#8217;s share price soared on the news. But minutes later, the SEC filing was pulled and shares were halted. Apparently <a href="http://www.forbes.com/sites/afontevecchia/2012/03/02/wynn-continues-to-rally-despite-sec-filing-screw-up-thank-macau/" target="_blank">Wynn jumped the gun on the announcement</a>, failing to jump through one last legal hoop. <p>Rumors reached fever pitch last week that a bill to legalize and regulate online poker in the U.S. would be tacked on to legislation extending payroll tax cuts. Senate majority leader Harry Reid (D-NV), however, denied the rumors on Thursday. Congress passed the payroll tax bill sans online poker legislation on Friday.</p>
<p>Poker players are all too familiar with gaming-related bills getting tacked on to other legislation. In 2006, the UIGEA was snuck on to the &#8220;must pass&#8221; Safe Port bill in the dead of night. Last week&#8217;s speculation gave full measure to the adage &#8220;turnabout is fair play.&#8221; </p>
<p>But U.S. players (and casino interests alike) remain hopeful that online poker legislation is still in the cards for 2012 despite the false alarm and Wall Street&#8217;s long odds.</p>

<p><span id="more-33104"></span>Many got rich during the original “boom years”, but brick and mortar gaming corporations for the most part saw only incremental benefits from the growth of online poker. Who can forget <a href="http://www.thehendonmob.com/articles/steve_lipscomb/a_letter.html">Steve Lipscomb&#8217;s bitter open letter</a> to the poker community, portraying the World Poker Tour as a jilted lover in a new poker world he helped create. (A world where his company failed to turn a profit while offshore online poker companies prospered was clearly unjust!)</p>
<p>WPT wasn&#8217;t the only one missing out on the majority of spoils from online poker&#8217;s first post-Moneymaker explosion. The recent deal-making frenzy suggests American casino corporations want to be the early adopters of PokerBoom 2.0. With partners in hand, casinos won&#8217;t be the wallflowers should the music start up for another “Moneymaker moment.”</p>

Andrew Cuomo delivered his State of the State address on Jan 4 to say, &#8220;We have long flirted and dallied with another potential economic engine &#8212; casino gaming &#8212; and when it comes to gaming, we&#8217;ve been in a state of denial.&#8221; Instead of flirting, Cuomo recommended a constitutional amendment that would finally consummate the state&#8217;s relationship with gaming.</p>
<p>Aside from making industry lobbyists flush, the governor claimed the Full Monty approach to gaming would generate $1 billion in economic activity. Of course estimated gaming-related revenues have to be taken with a grain of salt. In the fictitious town of Lake Wobegon, all the children were above average. When it comes to gaming revenue estimates, every state and municipality assumes an above-average piece of the pie, ignoring the expansion plans of its neighbors. <p>Not everyone stands to gain. NY currently has nine Indian casinos, five of which are run by the Seneca Nation. The Seneca have a 21-year agreement that gives them exclusive territorial gambling rights. <p><span id="more-32755"></span>Atlantic City can&#8217;t be too happy about Cuomo&#8217;s plans. It is already seeing some of its gambling revenues poached by Pennsylvania slot parlors and NY&#8217;s Racinos. But apparently Las Vegas is putting on a good front. This week, Howard Stutz writes, <a href="http://www.lvrj.com/business/gaming-s-spread-no-threat-to-strip-137844573.html">Gaming&#8217;s Spread No Threat to Strip</a>.</p>
<p>New Yorkers will undoubtedly get an earful about the societal costs associated with the expansion of gaming. In fact, it has already begun. The New York Post op-ed page is one of the first to ante up with <a href="http://www.nypost.com/p/news/opinion/opedcolumnists/the_house_loses_dqRnIkqexWcupbG6dpRvSL">The House Loses</a>.</p>
<p>The biggest potential winner will be Genting New York, a subsidiary of the Malaysian Genting Group. Genting recently opened the racino at Aqueduct raceway in Queens, NY. The company has committed $4 billion to build a new convention center on the site, betting it will be able to combine it with a full-fledged casino operation. It should come as no surprise that Genting greased the skids a little before the announcement of Cuomo&#8217;s State of the State address bestowing the virtues of the new convention center and expanded gambling. <p>It may take awhile before New York can pass a constitutional amendment to expand gambling. My guess is that will be just fine with gaming lobbyists.</p>

<p>With its stock price languishing after its initial public offering, Zynga needed a growth storyline that shareholders might believe. <p>The veiled implication is Wynn&#8217;s sizable donation might have been less than philanthropic &#8211; bordering on a &#8221;pay to play&#8221; ante to retain favor in the world&#8217;s most lucrative gaming destination. (The competing Las Vegas Sands&#8217; Macau operation is currently under DOJ and SEC scrutiny for possible infringement of the Foreign Corrupt Practices Act, as referenced <a href="http://blogs.wsj.com/corruption-currents/2011/10/21/las-vegas-sands-probe-explained/">here </a>in a Wall Street Journal blog.)</p>
<p>Wynn claims Okada&#8217;s lawsuit is just a smoke screen to mask the fact that Okada had been working behind Wynn&#8217;s back to develop a casino in the Philippines. <p>How will it end? Perhaps better than Steve Wynn&#8217;s marriage. After all, Wynn recently told the press, &#8220;I love Kazuo Okada as much as any man that I&#8217;ve met in my life.&#8221;</p>
