Jeff Ifrah seeks to have his day in federal court

Gaming attorney Jeff Ifrah and his law firm have removed the Nevada state civil case against them filed by Chad Elie to the US District Court for the District of Nevada. “Removal” refers to the transfer of a case from a state court to a federal court that includes the place where the state action was pending, so the venue in Nevada makes sense. Only defendants may remove cases to federal court. To remove, the case must be eligible to have been filed in federal court in the first place. In this case, the federal court’s diversity jurisdiction appears to be met because Elie and Ifrah are citizens of different states and the matter in controversy exceeds $75,000.

Presumably Ifrah wants to get this in front of the federal bench because he’s more confident of his hearing there than in state court. And perhaps there will be a further move to transfer this case east of Nevada, to another federal court. Time will tell.

The case is number 2:13-cv-00888-JCM-VCF.


Update on Elie v. Ifrah lawsuit

The attorney for Chad Elie filed an amended complaint against Jeff Ifrah, Ifrah PLLC, and others yesterday in the District Court of Clark County, Nevada. Recall that the original complaint had some very serious allegations made as against Ifrah (none of which have been proved in court). The amended complaint has the same basic claims for relief, but expands upon some of the earlier allegations and offers some further particulars.

For example, paragraph 3 of the complaint now pleads that Ifrah is licensed as an attorney in the District of Columbia but not in Nevada, California, Florida, or Illinois, even though “he performed services for and provided legal advice to” Elie while Elie was in those jurisdictions. (Interestingly, however, it’s not specifically pleaded that Ifrah gave Elie Nevada, California, Florida, or Illinois legal advice.) Paragraph 7 is now explicit in introducing the client conflict that is a big part of Elie’s purported case: that Ifrah was conflicted in representing both PokerStars and Full Tilt (for whom he is alleged to have been rustling up processing solutions) and Elie (who was exposed to criminal sanction for providing those solutions). This doesn’t change much; the original complaint was clear on this point, but the amended version ties this characterization in earlier in the narrative and gives some additional factual basis for it.

Another new tidbit is the claim that Ifrah requested that Elie’s payments to him be characterized as payments for “consulting” services rather than legal services (see new paragraph 59). Ifrah is alleged to have done this so that he would not be conflicted out of representing criminal defendants when and if indictments for payment processing were handed down, as Ifrah expected, for example, like those coming out of the SDNY on Black Friday. (See new paragraphs 60 and 74.) Elie’s amended complaint states that Ifrah subsequently denied that he even acted for Elie in putting together Elie’s processing deals.

Assuming that the original complaint was served on or about April 11th, Ifrah and his firm appear to have 10 days to respond to the amended complaint after service.

It was a fun weekend in Australia as two of the biggest names in poker captured WSOP APAC braclets. Phil Ivey won his 9th career bracelet in the Mixed Event, a tournament on the smaller side but impressive none the less. This win puts him in a tie with poker legend Johnny Moss and just one behind Doyle Brunson and Johnny Chan. After his run at the WSOP in 2012, there will be a lot of money on him winning another this summer.

Daniel Negreanu ended his 5 year WSOP drought by taking down the APAC Main Event for this 5th career bracelet. The title puts him in a tie with a boatload of other top players including Allen Cunningham, Ted Forrest, Scotty Nguyen, Jeff Lisandro, John Juanda, and the late great Stu Ungar. This was Negreanu’s second big chance to win a WSOP Main Event title after finishing 2nd at the WSOP Europe in 2009. It was probably fortunate he had to battle Daniel Marton heads up instead of having Barry Shulman own his soul.

Black Friday Fallout Continues

Courtesy of Nathan Vardi, today comes news that Chad Elie, a Black Friday defendant now serving federal time, has sued Washington D.C. lawyer Jeff Ifrah and his law firm, Ifrah PLLC, whom Elie alleges were retained to represent him. The complaint was filed yesterday in the District Court in Clark County, Nevada; a copy of the complaint is available here.

Part of the complaint is devoted to Ifrah’s defence (or purported lack thereof) of Elie in a prior case commenced in Nevada state court and subsequently removed to federal court.

But the potentially explosive part of the claim concerns alleged payments that Ifrah received payments from Elie’s LLC (21 Debit) as “commission[s] on procuring the deals with the banks which processed poker transactions.” In so doing, Elie alleges that Ifrah acted in a conflict of interest vis-a-vis Elie and his other clients and withheld critical information from Elie about the illegality of payment processing for online poker in the United States. Elie states that Ifrah received $100,000 per month as his cut for this processing and more than $1M in total therefrom.

The other incendiary claim is that Ifrah disclosed privileged and false information to the US Attorney for the Southern District of New York “in order to avoid indictment from the US Attorney’s office for his own illegal activities.”

This is just a complaint at this stage; none of this is evidence and nothing has been proved in court. Ifrah will doubtless respond. Given the seriousness of the allegations, the response should be every bit as good a read as the complaint.

Ludovic Lacay has been known as one of the best European players and now has a major championship to his credit after winning the EPT Sanremo Main Event. The French professional had booked over $2,000,000 in career earnings before this series but was having an admittedly bad run in recent months. The event drew a tough field by attracting many top pros to the casino on the Mediterranean coast and Lacay picked up €744,910 ($961,807) for outlasting them all.

Side note: Is the town spelled Sanremo or San Remo or Sanrœmu. All very confusing and PokerStarsBlog.com didn’t help my muddled brain. Back to your regularly schedule blathering.

Elsewhere in poker (and the forums naturally), attention over the last week was spent calmly and reasonably discussing the crazy situation of Phil Ivey winning £7.3 million playing Punto Banco in Britain’s oldest casino, only for them to turn around and deny payment. Not many missed the chance to have a little fun at Ivey’s expense, myself included, when the poor guy was owed millions yet a gaming company refused to let him cashout.

Completely made up Phil Ivey quote: “I am deeply disappointed and embarrassed that Crockford Casino players have not been paid money they are owed. I am not playing in the World Series of Punto Banco as I do not believe it is fair that I compete when others cannot. I am doing everything I can to seek a solution to the problem as quickly as possible.”

Full Tilt Poker Receives Isle of Man Operating License – It looks like one of the last hurdles to the new/improved/non-thieving Full Tilt Poker has been cleared with the company being granted their operating license. Plans are for a launch on November 6 and wasting no time by jumping into a new FTOPS series on December 2nd.

New Entourage-Style Show Based on Poker Circuit – Matt Salsberg, winner of the WPT Grand Prix de Paris, will be using his Hollywood skills to create a poker-related poker show. The brains behind Entourage and Weeds also spoke with our friends at PokerListing about results, movies, and Black Friday.

FeltStars Leaves Online Poker – Another poker site hits the bricks as FeltStars shutters operations on the Merge Network. For those few who still trust their money on U.S. facing poker sites, it’s another hit to their game. There were quite a few top name players signed on as FeltStar pros including Matt Brady, David “Devilfish” Ulliot, and Ylon Schwartz.

Plenty of action around the poker world, both on and off the tables. This week has one new WPT winnner, a boatload of new WSOP Circuit ring owners, and a new WPT Borgata Poker Open champion at some point later today. That final table has an interesting cast of characters including Steve Brecher, David Diaz, and Tyler Patterson after fan favorite Matt Brady was eliminated on the TV table bubble after a nasty beat. They are playing for over $800,000 and a shiny trophy.

The big news is off the table as PokerNews released their 7-part interview with Howard Lederer talking about the Full Tilt implosion, Black Friday, and pointing fingers at the entire universe with barely a mention of his role in the mess. There is a lot of information to get through and it is sometimes tough to listen. The interview does not provide many new facts not known already inside the poker world but it does confirm some stories.

It also provides plenty of ammunition for those who refuse to blame everyone responsible. Lederer and Bitar deserve every ounce of venom spewed their way (except for the death threats, those are childish/dangerous) but there is a set of people unwilling to spread it around. Phil Ivey and his ridiculous lawsuit. The list of people who gladly took massive “loans” against the player funds. The board members who didn’t immediately remove Bitar the moment they realized the mess they were in. They all deserve to be put on blast.

The unco-operative Mr. Beckley (Part II)

I wrote a blog post a week ago suggesting that Brent Beckley, who pleaded guilty on December 20th to two federal counts in the Black Friday indictments, may not be a co-operating witness for the government. This was based on a reading of the press release issued by the US Attorney’s Office for the Southern District of New York (the USAO) and a comparison of what we know of Mr. Beckley’s situation with what we know of Bradley Franzen’s circumstances. Recall that Mr. Franzen pled guilty this past May to three counts associated with the same superseding indictment. Last week’s post was not based on a review of Mr. Beckley’s plea agreement, a copy of which was posted at the Association of Players, Casinos, and Webmasters’ website.

Based on a comparison of Mr. Beckley’s plea agreement with Mr. Franzen’s plea agreement, I’m even more convinced that Mr. Beckley is not a co-operator.

The Unco-operative Mr. Beckley?

Brent Beckley pled guilty in US federal court in Manhattan yesterday to two counts contained in the criminal indictment unveiled in April of this year (United States v. Scheinberg et al). The first count was conspiracy to engage in unlawful Internet gambling, contrary to 18 U.S.C. § 371—this is a general conspiracy provision applied to the purported UIGEA violations. The second count was conspiracy to commit bank fraud and wire fraud, contrary to 18 U.S.C. § 1349, with reference to offences under 18 U.S.C. §§ 1343 and 1344. Mr. Beckley was the “director of payment processing for Absolute Poker,” according to the government’s press releaseVin Narayanan, who indicates that he has read the plea agreement, reports that federal prosecutors have recommended a sentence of between 12 and 18 months and that Mr. Beckley also agreed to forfeit $300,000 as part of his guilty plea.

One of the more intriguing parts of the US Attorney’s press release is the following sentence: “He [Mr. Beckley] is scheduled to be sentenced by United States Judge Lewis A. Kaplan on April 19, 2012, at 4:00 pm.”

Why is that interesting? Because I think it might indicate that Brent Beckley is not (or at least is not thus far) a co-operating witness for the government. I think he’s made his guilty plea to the court, thereby admitting his own involvement, but without rolling over on anyone else.

Barton Says Online Poker Bill Still Alive This Congress Rep. Joe Barton (R-TX) gave a luncheon keynote at the DGLP, where he spelled out how his online poker bill is moving forward as a piece of stand-alone legislation and/or still could be absorbed into some omnibus bills. Pretty straight-forward, honest-sounding stuff as Barton even talks about his own live real-money play and admits to multi-accounting for play money on PokerStars. [Pokerati Soundcloud]

Adelson Balks at Readiness for Online Poker The poker masses got spun into a tizzy after Vegas politico Jon Ralston “reported” that Las Vegas Sands Chairman Sheldon Adelson has been buzzing around DC that he is morally opposed to online gambling … and that age-verification technology isn’t ready yet. Ralston concludes that this could kill online poker’s chances in Congress as if Adelson alone is more powerful than the combined forces of Caesars, MGM, Steve Wynn, Station Casinos, Boyd Gaming, Michael Gaughan, et al. LUCKY US: More Poker Documentaries

I can already call it … 2012 will be the year of poker documentaries. The desire to tell true-life tales about the rise and fall of online poker in the USA should reach fever pitch as a classic story of crime and punishment plays out on Court TV. Ooh, that’s just in theory, of course, as we don’t yet know what’s on the docket for 2012 in the Southern District of New York nor Court TV’s programming schedule for next year. But it’s almost enough to get my conspiracy bells ringing over WSOP-Europe’s move to Cannes and/or the trend of using ALL CAPS in titles.

A lot of you already know about BOOM: The Incredible True Story of Online Poker, produced by Cardrunners icons Taylor Caby and Jay Rosenkrantz. Now, also coming soon, we have ALL IN: The Poker Movie, produced by the relatively big-time 4th Row Films.

Apparently both Boom and All In were all (or almost) ready to go right before Black Friday … which kinda caused a narrative breakdown in their endings.

I sat for both these films (as a talking head) … but have no idea whether or not my parts ended up on the cutting room floor. Kinda bummed I didn’t end up in the teaser below for All In … but hey, I guess I can understand appearing lower in the credits than Howard Lederer and Annie Duke.

(Can only imagine how excited producers must have gotten over Bernie Madoff-level allegations against one of their “stars”!)

Release date (and New York premiere party?) scheduled for February 2012. I really can’t wait to see how it all ends … on the big screen as well as in real life.

Remember how awesome SNL and the Onion were when they finally re-emerged after September 11th? Kinda the same thing, but with less death to navigate in the punchlines. Possibly the best episode yet, imho. (And a reminder for all that while we may take our poker seriously, we prolly shouldn’t take ourselves too seriously unless you want to end up like Durrrr and his flamingo.)

I won’t even list the humorous nuggets embedded in the Chase vs. ROFLs matchup … just watch and occasionally press pause when you see small print for refreshingly funny stuff.
